What Is Liquor License?

A liquor license is a license issued by the state excise agency to individuals who wish to sell alcoholic beverages in a specific location. Each state government has established licensing laws and restrictions that must be followed by anyone who wishes to sell hard liquor, beer, or wine. This license is only provided after a thorough review and examination of the Licensee’s personal information. It is illegal to sell liquor without a license, and it is a violation of many state statutes.

License for a Restaurant

For individuals who want to offer beer, wine, and liquor on the premises of their restaurant. It’s also known as an “all-liquor license.” These permits are issued to restaurants whose primary source of revenue is the sale of food, with alcohol accounting for only a small portion of their total revenue.

License to serve beer and wine

If you only want to sell beer and wine to your customers, this is the option for you. They are not permitted to sell alcoholic beverages or distilled spirits. Small eateries are granted these types of licenses.

License to Operate a bar

For individuals who want to sell beer, wine, and liquor, half of their revenue comes from alcohol sales and a half from food sales. This license is valid in some states, whereas in others, no such license exists because it is entirely dependent on the government in charge of that state, as well as local legislation. If you serve food and sell alcohol for half of your revenue, the state government may urge you to apply for this license.

India’s Liquor Laws

  • In India, a liquor license can only be obtained by someone who is at least 21 years old. The minimum age to receive a liquor license varies by state. For example, in Delhi, you must be 25 years old to receive a liquor license. The procedure of acquiring a liquor license is time-consuming and difficult.
  • The issue of “alcohol” is listed in the seventh schedule of the Indian constitution’s state list. As a result, the laws governing the sale and consumption of alcohol vary per state.
  • Article 47 of India’s constitution plainly directs states to improve public health and forbids intoxicating drinks and substances that are harmful to one’s health.
  • In several states, such as Gujarat, Bihar, Manipur, Nagaland, and the union territory of Lakshadweep, alcohol is prohibited. The sale, purchase, and consumption of alcohol is illegal in these states.

Why is a liquor license necessary?

It is prohibited to manufacture, sell, or distribute intoxicating liquor without a state license, and it is punishable under numerous state laws.

Alcohol has been consumed by people from all walks of life, whether they are wealthy, middle-class, or destitute. People are influenced by the ease with which information is available and the ineffectiveness with which laws are enforced. The state government put some laws and regulations on liquor licenses to control this. Before awarding a liquor licence to anyone, the details of the individual requesting the license should be thoroughly investigated. The improper sale of liquor licenses is reduced as a result of proper examination.

How To Apply For Liquor License In India?

Every state has its own rules and regulations related to the sale, purchase, and consumption of alcohol and it differs from state to state. A person applying for a liquor license must have full knowledge about the Liquor laws of his state laid down by the state excise department. The person can enquire about the rules and regulations from the following sources –

  • The state excise department’s website.
  • Liquor stores in the area
  • Physically going to the authority that issues licenses.
